New Zealand: CoF, RUC and the Health and Safety at Work Act
New Zealand has no rule that mandates a recorded daily check. The levers are different: vehicles must be kept to Certificate of Fitness condition at all times, a transport service licence holder must be fit and proper, and the Health and Safety at Work Act 2015 requires a business to provide and maintain safe plant. Escudo Fleet records CoF and RUC expiry per vehicle. NZ fleets are billed in AUD until NZD pricing is published.
Transport Service Licence and Certificate of Fitness
A goods service with vehicles of 6 tonnes or more needs a Transport Service Licence, and the holder must be fit and proper. Vehicles must be kept to CoF condition at all times. A CoF is usually six-monthly, and a failed CoF gives 28 days. Escudo Fleet records the CoF expiry per vehicle with a 30-day warning.
Daily checks
No NZ rule mandates a recorded daily check. NZTA’s roadside guidance says the driver and operator are both responsible and encourages a walk-around before each trip, with defects graded dangerous, serious or moderate. Transporting NZ has advised its members the same way.
Health and Safety at Work Act 2015, section 36
A PCBU must provide and maintain safe plant, and the duty cannot be contracted out. This is the lever. The Sorensen Transport (2019) and Refrigafreighters (2024) prosecutions were brought under HSWA, and both turned on maintenance systems.
No Chain of Responsibility
There is no statutory Chain of Responsibility in New Zealand. The nearest analogues are the overlapping PCBU duties under HSWA and the fit and proper test for licence holders. We say so plainly because the Australian wording does not transfer.
Operator Rating System
The Operator Rating System rule was never brought into force, and the administrative rating is on hold. We do not refer to it in the product.
Road User Charges, logbooks and work time
RUC expiry is recorded per vehicle with a warning before it runs out. Logbooks and work time are regulated separately and are outside what Escudo Fleet does.

What Escudo Fleet keeps for this
- A daily walk-around per vehicle with the driver identified, on templates you edit to your own wording
- CoF and RUC expiry per vehicle with 30-day warnings
- Defects graded and cleared by a named person, with photos
- Services by distance, hours or date, with work orders and the records of each
- Incidents and near misses reported from the phone with photos and other parties, kept as records only
- Everything exported as PDF or spreadsheet, stored in Sydney, Australia
Escudo Fleet helps you show that plant was maintained and faults were acted on. It does not satisfy a HSWA duty on its own, it is not approved by NZTA, and nothing on this page is legal advice.
